From the supplier: The National Conference of State Legislatures (NCSL) has passed a resolution calling on the National Association of Insurance Commissioners (NAIC) to reform its accreditation process. The NCSL resolution urges the NAIC to serve legislatures in an advisory, rather than a regulatory, capacity and to avoid using accreditation sanctions to push through legislation. It also calls for the creation of an advisory board of state legislators to help develop solvency standards.

From the supplier: The National Association of Insurance Commissioners (NAIC) did not find the Vermont insurance department to meet accreditation standards during a review. Vermont has two insurance codes, one for traditional insurance companies and another for non-traditional insurers. The NAIC review discovered that laws and procedures for traditional insurers are appropriate, but six of 20 laws for the non-traditional market were not based on NAIC model laws. Insurance Commissioner Elizabeth Costle disputes the NAIC’s authority in telling the state how to regulate insurance.

From the supplier: The accreditation program of the National Association of Insurance Commissioners must be reformed or it may prompt federal regulatory attention. The program should eliminate model laws that conflict with state legislatures and violate sunshine laws. The process should include a way for non-members to bring complaints, and a guarantee of due process for members. The lack of an independent entity to make accreditation decisions invites conflict of interest problems. Standards should be based on performance.
