Filing a claim against a driver with a Canadian insurance policy – accident in Florida (US).?
I was in an accident on Monday evening where the other driver ran a red light and t-boned my car totaling it and causing me multiple bodily injuries (and I’m 38 weeks pregnant). She was issued a citation for running the red light. I have hired an attorney since I have no comp/collision coverage on my policy so I have to pursue her insurance company on my own. After one call with them they were already trying to claim that she was not at fault even though she was issued the citation and I have an eyewitness who gave a statement to the officers that she did run the red light. She is insured with a company called The Co-Operators out of Canada.
Does anyone have any experience with this company or trying to seek money from an insurance company in another country? I’m also wondering what are the standard limits on coverage in Canada? I’m just so worried about not having a vehicle now that my baby is due in one week and I have yet to hear from them about a rental car being provided.

First, from what I have heard, Canadian Insurance
Companies are difficult to work with on 3rd party claims (which is what you are trying to do). I live on a border state and our claims person says it is always best to go on your own policy because it takes next to forever to get any response out of a Canadian Insurance company. Unfortunately, you do not have collision on your vehicle, that makes it tough. Has your attorney helped you at all? Your medical bills should be paid by your own company so you do not have to worry there. Another thing – the minimum limits in Canada are quite high – I have heard anywhere from $200,000 to $1,000,000, so you don’t have to worry there either. I think the problem is in Canada (depending on the province) if you contribute in any way to the accident then you don’t get paid – the only way you get paid by the other carrier is if you are 0% at fault & the other party is 100% at fault – such as in a rearend accident – an intersection accident will never come out like that. Also, in some provinces you can only sue the at fault party if you die or are dismembered (not much else). Of course the statutes in the state the accident happened would apply but the insurance company is going to try to go by their own rules. It sounds like you are going to have a big fight on your hands.
You stated you hired an attorney, so I’m not sure why you would be on here trying to find answers to questions.
Investigating the legalities of the claim (info on at-fault insurance company, info on at-fault driver’s limits and coverage available, etc) is the attorney’s job.
You hired the attorney, it’s his/her job to obtain this information.
At least in the Insurance & Regulation section of Yahoo Answers, I would have to say conservatively that 75% of the typical answers I’ve seen on here are incorrect anyway.
It’s your attorney’s job to obtain the correct information for you. Let your attorney do their job.
Actually I wouldn’t have recommended hiring an attorney in a case like this, but since you did, that would be your best source for information, not here.
Actually whether or not you have collision coverage, your insurance company would have been the best resource to collect from the person at fault.
But again, since you did hire an attorney, use his resources.
Is there a police report? If so, give a copy to the other person’s company. The report would indicate who got the ticket and why. If the other person is at fault, the police report is your proof.
And like others have said, your attorney is probably a better source for this information than we are! I’m sure you’re paying them big bucks, put their booty to work!
